By checking the “Terms of Service” box at checkout, all guests agree to the following terms of service:

1. ASSUMPTION OF RISK
I, the undersigned participant, acknowledge that I have voluntarily chosen to participate in a boat charter operated by A Charter In Time, LLC ("the Company"). I understand that boating and related activities involve inherent risks, including but not limited to injuries, falls, drowning, collisions, exposure to weather conditions, and equipment failure. I voluntarily assume all risks associated with my participation in this activity.

2. RELEASE OF LIABILITY
I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, waive, and discharge A Charter In Time, LLC, its owners, employees, agents, and affiliates from any and all claims, liabilities, demands, or causes of action, known or unknown, arising out of or related to any injury, loss, or damage sustained during or in connection with my participation in the boat charter.

3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless A Charter In Time, LLC, its owners, employees, agents, and affiliates from any claims, liabilities, damages, or expenses, including attorney’s fees, resulting from my actions, negligence, or breach of this agreement.

4. SAFETY AND COMPLIANCE
I agree to follow all safety instructions and guidelines provided by the Company and its crew members. I understand that failure to comply with safety rules or behaving in a reckless or disruptive manner may result in my removal from the vessel without a refund.

5. MEDICAL CONDITION AND FITNESS
I certify that I am physically and mentally capable of participating in this activity and have no medical conditions that would impair my ability to do so safely. I authorize the Company to obtain emergency medical treatment for me if necessary and understand that I am responsible for all associated medical costs.

6. ALCOHOL AND DRUG POLICY
I acknowledge that alcohol consumption may be permitted onboard in accordance with Washington State laws. I agree to drink responsibly and understand that excessive intoxication or the use of illegal substances will result in my immediate removal from the vessel and possible legal action.

7. PHOTOGRAPHY RELEASE
I grant A Charter In Time, LLC the right to use photographs or videos taken during the boat charter for promotional and marketing purposes without compensation.

8. GOVERNING LAW AND JURISDICTION
This agreement shall be governed by the laws of the State of Washington. Any disputes arising from this agreement shall be resolved in the courts of King County, Washington or San Juan County, Washington.

9. SEVERABILITY
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

10. ACKNOWLEDGEMENT OF UNDERSTANDING
I have read this liability waiver and fully understand its terms. By completing this online booking, I voluntarily sign this agreement, acknowledging that I am waiving substantial rights.
